Nascentra provides this service on an "as-is" basis for informational and entertainment purposes. We do not guarantee that the information provided is always the most current or that the application will be available in all territories or on all device configurations at all times.

3. Eligibility and Age Requirements

OneNinetyFive: World Geography is intended for a general audience; however, the primary target demographic is users aged 13 and older. If you are under the age of 18, you represent that you have reviewed these terms with a parent or legal guardian and that they have consented to your use of the app. Users under the age of 13 should only use the application under the direct supervision of an adult. Nascentra does not have access to your credit card numbers, banking details, or home billing address. If you encounter a billing error or an unauthorized transaction, you must contact Google Play Support directly, as Nascentra Labs does not have the technical authority to reverse charges or manage your financial account details on Google’s behalf.

8. Refund Policy and Purchase Disputes

All sales of virtual items within OneNinetyFive: World Geography are final and non-refundable, except where required by local consumer protection laws. If a purchase fails to deliver the expected digital item due to a technical error, you should contact us at nascentra@gmail.com with your Google Play transaction ID so we can manually verify and unlock the content. 10. Intellectual Property and Ownership

The design, code, quizzes, maps, graphics, and trademarks associated with OneNinetyFive: World Geography are the exclusive intellectual property of Nascentra Labs. This includes the proprietary "Geom" font family and the curated JSON datasets used to generate geography questions. You are granted a limited license to use the app for personal, non-commercial educational purposes. You may not copy, modify, distribute, sell, or lease any part of our services or included software. Reverse engineering or attempting to extract the source code of our Android application is a violation of international copyright laws and will be prosecuted to the fullest extent allowed by the jurisdiction of the infringement.

11. User Conduct and Prohibited Activities

Your use of OneNinetyFive must be lawful and respectful. You agree not to use the application for any purpose that is prohibited by these terms. 13. Community Standards for Leaderboards

While the app does not feature an open chat system, your identity is visible to others via your Google Play Games persona. You may not use a display name that impersonates another person, celebrity, or Nascentra Labs employee. 14. Local Data Storage Responsibilities

As OneNinetyFive utilizes local storage to save your game state, settings, and progress, you are solely responsible for the integrity of the data on your device. If you clear your app cache, perform a factory reset, or lose your phone without having synchronized your data with Google Play Games, your progress may be permanently lost. Nascentra Labs cannot recover data that was only stored locally on your device hardware. We highly recommend using the Google Play Games "Sync" feature to ensure that your geographic achievements are backed up to Google’s cloud. By using local storage, you accept the risk of data loss associated with hardware failure or manual data deletion.

15. Google Play Games Data Sync

The synchronization feature provided within the app is a convenience facilitated by Google. While we provide the bridge to this service, Nascentra does not control the uptime or reliability of Google’s cloud servers. You understand that there may be delays in syncing scores or achievements between different devices due to network conditions or Google service outages. If you choose to disconnect your Google account from the app, the cloud-based data will remain in your Google account but will no longer be accessible by the app until you re-authenticate. Your relationship with Google regarding their cloud services is independent of your relationship with Nascentra Labs.

16. Push Notifications and In-App Alerts

These notifications are managed locally by the Android OS and do not involve remote tracking by Nascentra servers. We do not use notifications for advertising or any third-party marketing purposes.

17. App Updates and Service Continuity

Nascentra Labs frequently releases updates to OneNinetyFive: World Geography to add new features, fix bugs, and update geographic data. These updates are distributed through the Google Play Store. You are encouraged to enable "Auto-Update" to ensure you are using the most secure and feature-complete version of the app. We reserve the right to discontinue support for older versions of the app or older Android operating systems as technical requirements evolve. While we aim for continuous service, we may occasionally need to suspend access to certain features (like leaderboards) for maintenance or due to changes in Google’s underlying service APIs.

18. Disclaimer of Warranties

NASCENTRA LABS PROVIDES THE ONENINETYFIVE APPLICATION ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DO WE WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE APP (SUCH AS GEOGRAPHY TEST SCORES) WILL BE ACCURATE OR RELIABLE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE APP IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NASCENTRA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY WITHIN THE APP, INCLUDING GOOGLE PLAY SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF NASCENTRA LABS EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR IN-APP PURCHASES IN THE SIX MONTHS PRIOR TO THE CLAIM.

20. Indemnification Clause

You agree to defend, indemnify, and hold harmless Nascentra Labs, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the OneNinetyFive application; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the educational services provided by our geography platform.

21. Termination of Access

Nascentra Labs reserves the right, without notice and in its sole discretion, to terminate your license to use the application and to block or prevent your future access to the app if we believe you have violated these Terms of Use or engaged in behavior that is harmful to our community or the integrity of our leaderboard system. You may also stop using the app at any time by uninstalling it. Upon termination, all licenses and other rights granted to you in these terms will immediately cease. Any virtual items associated with your local or cloud data will be forfeited, and Nascentra is under no obligation to provide a refund or compensation for any lost game progress or digital assets.

22. Governing Law and Dispute Resolution

These Terms of Use and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the jurisdiction where Nascentra Labs is officially registered, without regard to its conflict of law principles. You agree that any legal action or proceeding between you and Nascentra shall be brought exclusively in a court of competent jurisdiction located within our primary operating territory. 23. Severability and Entire Agreement
