Unlike many modern applications, Fined is built with a "privacy-first" philosophy, meaning we aim to keep your data exactly where it belongs: on your own device. This document outlines our commitment to your digital well-being and the legal frameworks we adhere to, ensuring that your journey toward focus is secure and private.

2. Identity of the Data Controller

For the purposes of international data protection laws, including the General Data Protection Regulation (GDPR), the "Data Controller" is Nascentra Labs. Since Fined operates primarily as a local-first application where data is stored within your device's isolated storage environment, you remain the primary custodian of your usage information. However, any interactions with our support channels, diagnostic reporting, or feedback services are managed by the Nascentra development team. We are committed to maintaining strict boundaries between your personal app usage habits and any external data processing activities required to maintain and improve the application.

3. Definitions and Scope

In this policy, "Fined," "Nascentra Labs," "we," "us," or "our" refers to the application and its developer, Nascentra. "Personal Data" refers to any information relating to an identified or identifiable natural person. "Usage Data" refers to information collected automatically through the use of the app, such as time spent in tracked applications. The "Background Monitor" refers to the native system-level service that monitors active screen activity. The scope of this policy covers all features within the Fined mobile application, including the tracking interface, the behavioral "pot" mechanism, and the background monitor service designed to trigger focus screens.

4. Consent and Legal Basis for Processing

We process your data based on several legal grounds. The primary basis is your explicit consent, which you provide during the onboarding process when you enable usage access and screen overlay permissions. Furthermore, processing is necessary for the performance of the service—specifically the ability to restrict access to distracting apps—that you enter into by using the application. We also rely on "legitimate interests" for improving the application’s stability and performance through anonymous crash reports. You have the right to withdraw your consent at any time by disabling permissions in your system settings or deleting the application.

Fined is designed to function primarily without the need for a centralized cloud database. We do not transmit your entire app catalog to any external servers. The inventory is used only to populate the selection menu and to enable the internal monitor to recognize restricted applications when they are launched by the user during the day.

8. Device Information and Diagnostic Data

To ensure technical compatibility and provide support, we may collect basic device information such as your device model, operating system version, and hardware specifications. This information is particularly relevant for our background monitoring service, which must adapt to different system power management policies and notification requirements. If the app crashes, diagnostic logs may be generated. These logs contain technical details about the state of the app at the time of the error but do not include your personal usage history or the names of the apps you were using unless explicitly stated.

9. Information from External Sources

Currently, Fined does not integrate with social media platforms, third-party login providers, or external data brokers. We do not purchase or acquire information about you from outside sources to supplement our internal data. Your profile within Fined is built entirely from the preferences you set and the usage patterns recorded by your device’s internal monitoring tools. This "closed-loop" data policy ensures that your digital identity within the app remains untainted by external tracking and that your focus journey is based purely on your actual behavior and personal goals.

10. Data Processing Purposes

The processing of data within Fined serves three main purposes: (1) Behavioral Enforcement—using usage stats to lock apps when limits are reached; (2) Self-Reflection—providing you with daily adherence reports and penalty records to visualize your progress; and (3) Application Optimization—ensuring the background service runs efficiently without draining your battery. We do not use your data for advertising, profiling for commercial purposes, or selling to third parties. Every byte of data processed is geared toward the singular goal of reducing your digital distractions and improving your time management.

11. Automated Decision-Making and Profiling

Fined uses a simple automated logic to trigger the focus screen based on your predefined limits. While this is a form of automated decision-making, it is entirely controlled by the parameters you set during configuration. There are no hidden algorithms or complex behavioral profiling techniques that try to guess your mood or predict your next move. The logic is transparent and deterministic: once a limit is reached, a focus screen is triggered. You are always in control of these rules, and the app simply acts as a neutral enforcer of the boundaries you have voluntarily established.

12. Local Storage Mechanism

Technical persistence in Fined is handled via an encrypted internal storage directory provided by your device's operating system. This storage includes your tracked apps list, your progress records, and your daily adherence snapshots. Your operating system's security model protects this directory, meaning other applications cannot read this data. When you clear the app's data in system settings or uninstall the app, this storage is completely and permanently wiped. We do not use external or shared storage (such as SD cards) to store sensitive usage logs, ensuring maximum data security.

13. Data Minimization and Privacy by Design

We adhere to the principle of data minimization, which states that an app should only collect the minimum amount of data necessary to perform its function. Fined does not ask for your name, email, phone number, or location. We do not require account creation to use the core features. If you wish to start over, the "Reset Data" option in the settings menu will purge all internal records and keys immediately and permanently.

These assets are compiled directly into the app's binary. We do not use third-party analytics services that track your movement across other apps or websites. 16. International Data Transfers

Since Fined stores data locally on your device, international data transfers of your usage habits do not occur. Your data remains in your physical location. Because Fined is a local-first app, you can exercise these rights directly through the interface without needing to wait for a response from a data protection officer. 18. GDPR Compliance (EU/EEA Users)

For users in the European Economic Area, we comply with the General Data Protection Regulation (GDPR). We process your data based on your consent and the necessity of the service. We provide transparency through this policy and ensure that you can export or delete your local data at any time. We do not engage in high-risk processing or large-scale profiling. If you believe our processing of your data infringes upon GDPR, you have the right to lodge a complaint with a supervisory authority in your country of residence, though we encourage you to contact Nascentra Labs first.

19. CCPA and CPRA Compliance (California Users)

21. System Permissions: Usage Access

The "Usage Access" permission is the cornerstone of Fined's ability to help you. By granting this, you allow your operating system to share app usage durations with our background monitoring service. This is a sensitive permission that requires manual activation in your system settings. Nascentra uses this strictly to calculate your progress toward your daily limit. We do not use this permission to read your messages, view your photos, or track your location. It is used solely as a digital stopwatch to help you stay within your predefined time boundaries and reach your focus goals.

22. System Permissions: Screen Overlay

The "Overlay" or "Appear on Top" permission allows Fined to display the focus screen when you have exceeded your limit. Without this, the app could notify you, but it couldn't effectively block your access to the distracting application. When the monitor detects a restricted app, it launches a high-priority window that sits on top of all other active windows. This is a purely functional use of the permission. We do not use overlays to trick you into clicking advertisements or to capture your screen content; its only purpose is to help you maintain your focus during work hours.

23. Background Processing and Notifications

To ensure the monitoring service isn't terminated by your device's power management system, it runs as a persistent background process. This is why you see a status notification when Fined is active. This notification serves as a transparency tool—it tells you exactly when Nascentra's monitor is active. You can stop the service at any time from within the app settings. The service is optimized for low power consumption and only performs lightweight checks of the active application identifier to ensure that your device's performance is not noticeably impacted while monitoring.

24. Technical Security Measures

Even though data is stored locally, Nascentra Labs takes technical security seriously. The internal components of the app communicate via secure channels provided by the operating system. Data stored internally is subject to hardware-level encryption on supported devices. We follow secure coding practices to prevent common vulnerabilities like unauthorized data broadcasting or leakage between app components. By minimizing the attack surface (no cloud servers, no API keys, no PII), we provide a robust and secure environment for your habit data, protecting it from external malicious actors.

25. Data Breach Notification Protocol

In the unlikely event that a security vulnerability is discovered within the Fined app that could lead to local data exposure, we will release an emergency update through the Google Play Store. Since Nascentra does not have your email address, we cannot notify you individually. We recommend keeping the app updated to the latest version to ensure you have the latest security patches. Our commitment to local storage means that even if our development infrastructure were compromised, your individual app usage logs would remain safe on your device, isolated from the breach.

26. Payments and Financial Data

Fined may offer optional digital content or premium features through your platform's billing system. When you make a purchase, we do not store your credit card or payment details on our servers. All financial transactions are handled securely by the official app store. Nascentra only receives a confirmation token that the transaction was successful to unlock the corresponding feature. By using these features, you acknowledge that your financial data is subject to the privacy policy of the third-party billing provider and the platform through which the purchase was initiated.

27. No-Refund Policy and Finality

Nascentra Labs maintains a strict No-Refund Policy for all digital products, premium subscriptions, or virtual items purchased within Fined. Once a digital asset is unlocked or a focus-related feature is activated, the service is considered "consumed" in full. We do not offer credits, exchanges, or refunds for unused portions of a subscription or for dissatisfaction with the application's effectiveness. By initiating a purchase, you agree to the finality of the transaction and waive any right to a refund under the maximum extent permitted by the laws of your jurisdiction.

28. Exclusion of Liability for Financial Loss

Nascentra shall not be held liable for any financial losses, whether direct or indirect, resulting from the use of Fined. This includes, but is not limited to, the cost of any "fines" recorded within the app, the price of premium features, or any lost productivity costs. The application is a tool for self-discipline, and the user assumes all risks associated with its behavioral enforcement mechanisms. We are not responsible for any monetary disputes arising from the user's decision to utilize the app's penalty features or from any technical errors that may occur during the billing process.

29. Changes and Updates to this Policy

As Fined evolves, Nascentra Labs may update this Privacy Policy to reflect new features or changes in legal requirements. Any changes will be posted within the app, and the "Last Updated" date at the bottom will be changed accordingly. If a change is significant (such as introducing cloud sync features), we will provide a more prominent notice within the app and ask for your renewed consent.
