1. Acceptance of These Terms
By downloading, installing, or using the Fined application ("the App"), you agree to be bound by these Terms of Use ("Terms"). This is a legal agreement between you and Nascentra (published as Nascentra Labs). If you do not agree to these terms, you must not install or use the App. Your continued use of Fined constitutes your ongoing acceptance of these Terms and any future modifications we may make. These Terms are designed to ensure a safe, effective, and transparent environment for all users seeking to improve their digital habits and break the cycle of app addiction through our specialized monitoring tools.
2. Eligibility and Age Requirements
Fined is intended for users who are at least 13 years of age (or the minimum age required in your country to consent to data processing). If you are under the legal age of majority in your jurisdiction, you represent that you have reviewed these Terms with your parent or guardian and that they have consented to your use of the App. Nascentra Labs does not knowingly allow use by individuals who cannot legally enter into these agreements. By using the App, you warrant that you meet these eligibility requirements and that your use does not violate any applicable local laws or regulations in your region.
3. License to Use the Application
Subject to your compliance with these Terms, Nascentra grants you a limited, non-exclusive, non-transferable, and revocable license to download and use Fined for your personal, non-commercial purposes on a device that you own or control. This license does not grant you any rights to the source code, branding, or proprietary logic used within the App. Any attempt to use the App for commercial gain, such as charging others to access its features or redistributing the App as your own, is strictly prohibited and will result in the immediate and permanent termination of your license.
4. Intellectual Property Rights
All content included in the App, such as text, graphics, logos, icons, images, and the underlying software architecture, is the property of Nascentra or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our express written consent. "Fined," "Nascentra Labs," and our official logo are trademarks that may not be used in connection with any product or service that is not ours without explicit authorization.
5. User Responsibilities and Conduct
You are responsible for how you use Fined. You agree not to use the App in any way that is unlawful, harmful, or interferes with the App's normal operation. Specifically, you agree not to attempt to bypass the App's locking mechanisms through unauthorized technical means, not to attempt to decompile the monitoring service, and not to use the App to harass or harm others. You acknowledge that Fined is a tool for self-discipline, and you agree to use it in the spirit of self-improvement for which it was designed by Nascentra, respecting the boundaries you set for yourself.
6. Prohibited Activities and Abuse
To maintain the integrity of our service, certain activities are strictly prohibited. These include, but are not limited to: (a) attempting to gain unauthorized access to our systems; (b) using any automated system, such as "bots" or "spiders," to access the App; (c) transmitting any viruses or malicious code; (d) interfering with system permissions in a way that causes the App to malfunction; and (e) using the App for any fraudulent purposes. Any violation of these prohibitions may result in legal action by Nascentra Labs and the immediate termination of your access to the App and its specialized features.
7. App Functionality and Background Monitoring
You understand that Fined requires specific system-level permissions to function, including usage tracking and screen overlay permissions. The App utilizes a specialized background service developed by Nascentra to monitor your active window status. You acknowledge that this service must remain active for the App to block distracting applications effectively. While we strive for high reliability of the monitor, we cannot guarantee that the service will never be interrupted by your operating system’s power management. You agree that the App is a "best-effort" tool for digital habit management.
8. Accuracy of Usage Data
Fined relies on the data provided by your mobile device's system APIs. While this data is generally accurate, there may be discrepancies between the time recorded by the system and your actual perceived usage time. Factors such as apps running in split-screen mode, background processes, or system resource limitations can affect the reported duration. You agree that Nascentra Labs is not responsible for any inaccuracies in usage reporting and that the "fine" mechanism is based on the data reported by your device's operating system, which our software processes as the source of truth.
9. The Fine and Reward Mechanism
The core feature of Fined is the "Fine" system, where users record a symbolic penalty for unlocking an app after a limit has been reached. You acknowledge that these "fines" are currently symbolic and are recorded within the App's local database for behavioral tracking purposes. If future versions of the App include actual financial transactions (such as donations or premium features), those will be governed by additional specific terms. You agree that the App's primary goal is to create a psychological deterrent and habit-breaking loop, not to create actual legal or financial obligations.
10. Financial Transactions and Billing
Should Fined offer in-app purchases or subscriptions, these will be processed through your mobile platform's official billing system. You agree to comply with the platform's terms and conditions regarding payments. All sales are final, and Nascentra Labs maintains a strict no-refund policy for all digital services. Nascentra reserves the right to change our pricing at any time, but any changes to subscription fees will be communicated to you in advance. You are responsible for all charges incurred under your account, including any taxes applicable to your purchase in your jurisdiction.
11. Third-Party Links and External Content
The App may contain links to third-party websites or services that are not owned or controlled by Nascentra. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Nascentra shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. Always review the terms of third-party platforms you visit.
12. Device Compatibility and System Support
Fined is developed for specific mobile platforms by Nascentra Labs. We do not guarantee that the App will be compatible with all devices or all versions of the operating system. As system updates are released, the App may require updates to remain functional. You are responsible for ensuring that your device meets the minimum hardware and software requirements and for keeping the App updated via the official store. We are not liable for any failure of the App resulting from system updates, manufacturer-specific customizations, or the installation of custom software that interferes with system APIs.
13. Internet Connectivity and Data Usage
While Fined is designed to work primarily offline, certain features (like downloading assets, checking for updates, or sending support requests to Nascentra) require an active internet connection. You are responsible for any data charges incurred while using the App. Depending on your mobile plan, your carrier may charge you for data usage. We recommend using the App on a stable Wi-Fi connection when possible to avoid unexpected costs. We are not responsible for any limitations in functionality that occur because you do not have an active or stable internet connection available.
14. Support, Maintenance, and Updates
Nascentra may provide support for the App through email, WhatsApp, or in-app feedback mechanisms. However, we have no obligation to provide any maintenance or support services. We reserve the right to release updates that add, modify, or remove features at our sole discretion. These updates may happen automatically or require manual intervention. You agree that we are not liable for any changes to the App's functionality or for any temporary downtime required for maintenance or the deployment of new features and security patches intended to improve the Fined experience.
15. Feedback and User Submissions
We welcome your suggestions, ideas, and feedback regarding Fined. If you submit any feedback to Nascentra Labs, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, disclose, and exploit that feedback for any purpose without any obligation or compensation to you. We are always looking for ways to improve the App, and your input is invaluable. However, please be aware that any information you send us is not confidential and may be used to improve the service for all users within the Fined community, helping everyone break their digital distractions.
16. Privacy and Data Usage Integration
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Fined, you consent to the collection and use of your data as described in the Privacy Policy. Nascentra emphasizes that your usage data is stored locally. You agree that the App has the right to access the necessary system APIs to perform its functions. It is your responsibility to review the Privacy Policy regularly to ensure you understand how your information is being handled within the local application environment on your device without being uploaded to our servers.
17. Modification of Services and Features
Nascentra Labs reserves the right to modify or discontinue, temporarily or permanently, the App or any feature within it at any time without notice. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the App. This includes changes to the way the tracking logic works, the tone of the messages, or the metrics shown in the adherence reports. We strive to improve the user experience continuously, and this may involve experimenting with different behavioral techniques to help you reach your goals faster.
18. Termination of Access and Use
We reserve the right to terminate or suspend your access to Fined immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms. Upon termination, your right to use the App will cease immediately. If you wish to terminate your agreement with Nascentra, you may simply stop using the App and uninstall it from your device. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability regarding your use.
19. Disclaimers of Warranty
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NASCENTRA LABS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF THE APP WILL MEET YOUR EXPECTATIONS.
20. Limitation of Liability and Non-Liability Clause
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NASCENTRA LABS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF YOUR USE OF THE APP. THIS INCLUDES, BUT IS NOT LIMITED TO, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA. WE ARE NOT LIABLE FOR THE APP'S FAILURE TO SUCCESSFULLY BLOCK DISTRACTING CONTENT OR FOR ANY PSYCHOLOGICAL OR FINANCIAL CONSEQUENCES ARISING FROM THE USE OF OUR HABIT-BREAKING TOOLS. YOUR USE OF THE APP IS ENTIRELY AT YOUR OWN RISK.
21. Indemnification and Defense
You agree to defend, indemnify, and hold harmless Nascentra Labs and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the App; (b) a breach of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms and your use of the Fined application, ensuring the developer is protected from misuse.
22. Force Majeure Events
Nascentra shall not be held responsible for any failure to perform our obligations under these Terms if such failure results from any cause beyond our reasonable control. This includes, but is not limited to, mechanical, electronic, or communications failure or degradation, natural disasters, war, acts of terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials, or any other event that makes the fulfillment of these Terms commercially impracticable or impossible in our primary region of operation.
23. Export Controls and Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all local, state, federal, and international laws, statutes, ordinances, and regulations that apply to your use of the App, including all applicable export and import laws and regulations of the United States and other countries where Nascentra Labs distributes its software.
24. Dispute Resolution and Arbitration
Most concerns can be resolved quickly by contacting Nascentra directly. In the event that we cannot resolve a dispute, you and we agree to settle any claim or controversy through binding arbitration rather than in a court of general jurisdiction. Arbitration uses a neutral arbitrator instead of a judge or jury and is more informal than a lawsuit. The arbitration will be conducted in the English language and will take place in Pakistan. You and we agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.
25. Class Action Waiver
YOU AND NASCENTRA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Nascentra Labs agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. This waiver is a critical part of our agreement to arbitrate and ensures that legal matters are handled in a focused and efficient manner for all parties.
26. Severability of Provisions
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. Nascentra's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The invalidity of one part of this agreement does not invalidate the entire agreement; the core intent of the Terms and the protection of Nascentra Labs will remain enforceable.
27. Waiver of Provisions and Rights
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Nascentra's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Nascentra Labs. We reserve all rights not expressly granted to you in these Terms, maintaining the developer's ownership and control over the software and its proprietary features.
28. Strict No-Refund Policy
BY MAKING A PURCHASE WITHIN THE APP, YOU EXPLICITLY AGREE THAT ALL TRANSACTIONS ARE FINAL AND NON-REFUNDABLE. Nascentra Labs does not offer refunds for digital content, subscription renewals, or virtual penalties, regardless of the reason for the request. This include instances where the user forgets to cancel a subscription or finds the app's features to be unsatisfactory. It is your responsibility to evaluate the App before making a purchase. Any disputes regarding billing must be handled through the official platform store, though Nascentra will not authorize refunds through those channels.
29. Entire Agreement and Language
These Terms, together with the Privacy Policy and any other legal notices published by Nascentra Labs in the App, constitute the entire agreement between you and Nascentra regarding the App. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party. In the event of any conflict between the English version and any translated version of these Terms, the English version shall prevail.
