These Terms of Use ("Terms") constitute a legally binding agreement between you and Nascentra, also referred to as Nascentra Labs, regarding your access to and use of the KiWi Vault mobile application and any related digital services. Throughout this document, "we," "us," and "our" refer to the collective teams at Nascentra Labs. By downloading, installing, or utilizing KiWi Vault, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these protocols, you are expressly prohibited from using the application and must discontinue its use immediately. This agreement ensures that the engineering standards and legal boundaries of our software are respected by all parties.
1. Acceptance of Service Protocols
Accessing KiWi Vault implies a full acceptance of the technical and legal frameworks established by Nascentra. These Terms govern your relationship with Nascentra Labs and outline the responsibilities you assume as a user of a localized, encrypted environment. This is a legally binding contract; if you are using the application on behalf of an entity, you represent that you have the authority to bind that entity to these Terms. We reserve the right to modify these protocols at any time to reflect updates in our engineering standards or global regulatory requirements. Continued use of the application following any such modifications constitutes your acceptance of the updated Terms, which are always available for review within the application's legal section.
2. Description of Zero-Knowledge Service
KiWi Vault is engineered by Nascentra Labs as a "Zero-Knowledge" localized security tool. The primary service provided is a secure, encrypted sandbox on your device for the storage of sensitive digital assets. Unlike traditional cloud-based storage providers, Nascentra does not act as a custodian of your data. The application facilitates the transformation of your files into an encrypted state via local hardware resources. You acknowledge that our service is limited to the provision of the software tool itself; we do not provide data hosting, remote synchronization, or server-side management. The functionality of the app is predicated on its "Offline-First" nature, ensuring that your digital life remains entirely within your physical possession.
3. User Representations and Digital Conduct
By utilizing KiWi Vault, you represent and warrant to Nascentra that you have the legal capacity to enter into this agreement and that you will comply with all applicable local and international laws. You agree not to use the application for any unauthorized or illegal purposes. While Nascentra Labs does not have the technical capability to monitor your content due to our Zero-Knowledge architecture, you are legally responsible for the nature of the data you choose to encrypt. Furthermore, you represent that you will not attempt to bypass, disable, or otherwise interfere with the security features of the application or attempt to reverse-engineer the proprietary encryption logic developed by our engineering team.
4. Proprietary Intellectual Property Rights
Unless otherwise indicated, KiWi Vault and all associated software, source code, design elements, logos, and trademarks are the proprietary property of Nascentra and are protected by international copyright and trademark laws. Nascentra Labs grants you a limited, non-exclusive, non-transferable, and revocable license to use the application for personal, non-commercial purposes on a device you own or control. This license does not grant you any rights to the underlying source code or any derivative works. Any unauthorized use of our intellectual property, including the "KiWi" brand and the specific UI/UX designs crafted by us, is strictly prohibited and may result in the termination of your access to the service.
5. Data Sovereignty and User Responsibility
A fundamental pillar of the Nascentra Labs philosophy is data sovereignty. You acknowledge that you are the sole custodian of all information stored within KiWi Vault. Because we do not host your data, Nascentra cannot be held responsible for the loss, corruption, or unauthorized access of your files. You are solely responsible for managing your local storage and ensuring that your device remains secure. We strongly advise users to maintain original backups of their files outside of the vault environment. You accept that any loss of data resulting from device failure, hardware damage, or software errors is your sole responsibility as the physical owner of the storage medium.
6. Local Credential Management (No Backdoors)
Due to our strict adherence to Zero-Knowledge security protocols, Nascentra does not maintain a "master key" or a "forgot password" mechanism. Your access credentials (PIN, Pattern, or Password) are the only keys to your encrypted data. You acknowledge that if you lose these credentials and have not configured local Security Questions, your data will become mathematically unrecoverable. Nascentra Labs engineers have intentionally built the system without backdoors to ensure maximum security; consequently, we have no technical ability to assist you in regaining access to your vault. The maintenance and protection of your access credentials are your absolute and non-negotiable responsibility.
7. App Uninstallation and Data Deletion Protocol
You are cautioned that uninstalling KiWi Vault from your device will result in the immediate and permanent deletion of the local encrypted container and all assets held within it. Because Nascentra does not sync your data to a cloud server, there is no way for us to restore your information once the application has been removed from your hardware. We recommend that users export (unhide) their assets to their public gallery in their original format before performing an uninstallation or a factory reset of their device. You agree that Nascentra Labs shall not be liable for any data loss that occurs as a result of app removal, whether intentional or accidental.
8. Premium Subscriptions and Financial Transactions
KiWi Vault offers enhanced security features through a subscription model (Monthly, Annual, or Lifetime). All financial transactions are processed exclusively through Google Play Billing Services. You agree to comply with Google’s Terms of Service regarding payments and refunds. Nascentra does not collect, store, or process your credit card information or personal billing details. Any disputes regarding billing, subscription renewals, or refund requests must be directed to the Google Play Store. We reserve the right to modify our pricing structures or feature tiers at our sole discretion, with any such changes being communicated via the application or store listing.
9. Hardware and System Requirements
The performance of KiWi Vault is dependent on your device hardware and operating system. The application requires certain hardware permissions—including camera access, biometric hardware interaction, and network connectivity for license checks—as detailed in our Google Play Store listing. You are responsible for ensuring your device meets the technical requirements for the application to function correctly. Nascentra Labs is not responsible for performance issues or security vulnerabilities arising from outdated device firmware, compromised operating systems (e.g., rooted devices), or insufficient local storage capacity.
10. Prohibited Engineering Interference
Users are expressly prohibited from attempting to decipher, decompile, or disassemble any part of the KiWi Vault software. The cryptographic implementations and file-handling logic are the result of significant engineering investment by Nascentra Labs. Any attempt to probe the application for vulnerabilities, perform unauthorized security testing, or scrape data from the application interface is a violation of these Terms. We reserve the right to implement technical measures to detect and prevent such interference and to terminate the license of any user found to be engaging in activities that threaten the integrity of our software ecosystem.
11. Disclaimer of Technical Warranties
KIWI VAULT IS PROVIDED BY NASCENTRA ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NASCENTRA LABS DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, BUG-FREE, OR ENTIRELY IMMUNE TO ADVANCED CYBER-ATTACKS. WHILE WE EMPLOY RIGOROUS AES-256 ENCRYPTION, THE ULTIMATE SECURITY OF THE DATA DEPENDS ON USER CONDUCT AND DEVICE INTEGRITY. YOUR USE OF THE SERVICES IS AT YOUR OWN DISCRETION AND RISK.
12. Absolute Limitation of Liability
IN NO EVENT SHALL NASCENTRA, NASCENTRA LABS, OR OUR DIRECTORS AND EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OUR SOFTWARE. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF DATA, LOSS OF PROFITS, OR REPUTATIONAL DAMAGE RESULTING FROM DATA BREACHES ON THE USER'S DEVICE OR THE LOSS OF ACCESS CREDENTIALS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PREMIUM FEATURES OF THE APPLICATION DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification of the Company
You agree to defend, indemnify, and hold harmless Nascentra and Nascentra Labs from any claims, damages, or expenses (including legal fees) arising out of your use of the application, your violation of these Terms, or your infringement of any third-party rights. This indemnification covers any legal challenges resulting from the nature of the content you store within the vault or any unauthorized modifications you attempt to make to the software. We reserve the right to assume the exclusive defense of any matter subject to indemnification by you.
14. Modifications to Service and Updates
Nascentra Labs reserves the right to modify, suspend, or discontinue any aspect of the application at any time without prior notice. We may release updates to improve security, fix bugs, or introduce new features. You acknowledge that some updates may be mandatory for the continued secure operation of the vault. While we strive to maintain backward compatibility, we are not liable for any issues arising from the use of outdated versions of the application. The continuous evolution of our software is a core part of our commitment to providing elite privacy tools.
15. Electronic Communications and Support
By using KiWi Vault, you consent to receive electronic communications from us regarding technical updates, license verifications, or support inquiries. Any notices we provide electronically satisfy any legal requirement that such communications be in writing. For technical support, users must manually initiate contact with our team. We do not automatically collect diagnostic data, meaning our ability to provide support is limited to the information you voluntarily provide during our correspondence.
16. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of international commerce and the regulations generally accepted in global digital services, without regard to conflict of law principles. Any dispute arising from this contract that cannot be resolved through mutual negotiation shall be referred to and finally resolved by arbitration under standard international rules. You agree that any legal proceedings must be conducted on an individual basis and not as a class action.
17. Severability and Entire Agreement
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed from the agreement without affecting the validity and enforceability of the remaining provisions. These Terms, along with our Privacy Policy, constitute the entire agreement between you and Nascentra regarding the use of KiWi Vault. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right.
